What Is an Affidavit of Proof of Service of Publication?

In Philippine land registration proceedings under PD 1529 (Property Registration Decree), the court must be satisfied that all interested parties had notice of the proceedings before it issues a decree of registration. The Affidavit of Proof of Service of Publication is the sworn certification that both service on known parties and newspaper publication were completed as required by the court's Order of Initial Hearing.

It brings together — in one sworn document — proof of: (a) publication in a newspaper of general circulation, (b) posting on the property and at government offices, and (c) service on named respondents (heirs, adjoining owners, government agencies).

Legal Basis: PD 1529, Section 23

Under PD 1529, Section 23, upon filing of an application for original registration, the court issues an Order of Initial Hearing directing:

  • Publication of the order in the Official Gazette and a newspaper of general circulation, once in each
  • Mailing of the order to adjoining owners, interested parties, and government agencies
  • Posting of the order on the subject land, at the courthouse, and at the bulletin board of the municipality

After the publication period runs, the applicant (through counsel) files the Affidavit of Proof of Service of Publication together with the actual tearsheets and receipts to demonstrate compliance.

Frequently Asked Questions

What is an Affidavit of Proof of Service of Publication?
An Affidavit of Proof of Service of Publication is a sworn statement combining two types of proof: (1) that the notice was personally served on (or sent to) known interested parties, and (2) that it was published in a newspaper of general circulation on the required dates. It consolidates both service and publication compliance into one sworn document.
When is it required in Philippine land registration?
Under PD 1529 (Property Registration Decree), in original land registration cases, the applicant must prove to the court that: (a) the order of initial hearing was published twice in the Official Gazette and a newspaper of general circulation, and (b) notice was posted and served on adjoining owners and government agencies. The Affidavit of Proof of Service of Publication is the sworn evidence of compliance.
Who executes this affidavit?
It is typically executed by: (a) the sheriff or clerk of court who performed the personal service, and/or (b) the applicant's lawyer or representative who oversaw publication. Different facts are attested by the person who personally did each act — service or publication.
What is the difference between this and an Affidavit of Publication?
An Affidavit of Publication (executed by the newspaper) certifies only the fact of newspaper publication. An Affidavit of Proof of Service of Publication covers both service on interested parties AND newspaper publication — it is a broader compliance certificate, often required by the court or LRA after the publication period has run.
What documents are attached to this affidavit?
Attachments typically include: copies of the newspaper publication (tearsheets), Official Gazette publication if required, registry receipts for mailed copies, return cards from mailed notices, and any other evidence of service on specifically named parties.
