What Is an Affidavit of Publication?

An Affidavit of Publication is a sworn certification by a newspaper's authorized officer that a particular legal notice, announcement, or advertisement was published in their newspaper on the specified dates, in the specified form, and in a newspaper that qualifies as one of general circulation in the relevant province or city.

Like any affidavit, it is a form of Sinumpaang Salaysay — the Filipino term for a sworn statement — drafted in English and notarized so that courts and the LRA will accept it.

Philippine law requires newspaper publication for numerous legal proceedings — the affidavit is the evidence that the publication requirement was actually fulfilled. Courts and the Land Registration Authority (LRA) require it before they will process the corresponding petition or application.

When Is an Affidavit of Publication Required?

  • Original land registration (LRA) — notice of initial hearing published once a week for two consecutive weeks
  • Extra-judicial settlement of estate — published once a week for three consecutive weeks (Section 1, Rule 74, Rules of Court)
  • Petition for change of name — notice published once a week for three consecutive weeks
  • Lost owner's duplicate certificate of title — court order to publish notice
  • Dissolution of corporations and partnerships
  • Foreclosure sale notices — judicial and extrajudicial foreclosure require newspaper publication
  • Local government ordinances — required by the Local Government Code

Frequently Asked Questions

What is an Affidavit of Publication in the Philippines?
An Affidavit of Publication is a sworn statement by an authorized representative of a newspaper (usually the publisher or editor) certifying that a specific notice, advertisement, or legal announcement was published in their newspaper on the stated dates and in the stated form.
When is an Affidavit of Publication required?
Common requirements include: land registration proceedings (notice of initial hearing), extra-judicial settlement of estate (published once a week for three consecutive weeks), name change petitions, lost title cancellation and issuance, dissolution of partnership or corporation, and government notices required by law to be published in a newspaper of general circulation.
Who executes an Affidavit of Publication?
The Affidavit of Publication is executed by the publisher, editor, or an authorized officer of the newspaper where the notice was published — not by the party who ordered the publication. It is the newspaper's certification of the fact of publication.
What is a newspaper of general circulation in the Philippines?
A newspaper of general circulation is published for the dissemination of local news and general information, has a bona fide subscription list of paying subscribers, and is published at regular intervals. For legal publications, the court or LRA may specify that the newspaper must be one of general circulation in the province or city where the land is located.
What is attached to an Affidavit of Publication?
The actual clipping of the published notice (the tearsheet) is attached as an annex to the Affidavit of Publication. This physical evidence of publication, together with the affidavit, constitutes the required proof of publication.
What is an Affidavit of Publication called in Tagalog?
There is no separate Tagalog caption in common use — it falls under the general term Sinumpaang Salaysay, which means a sworn statement. The affidavit is almost always drafted in English because it is filed with courts and the LRA, and the notarized English version is accepted everywhere.
